By accessing and using the services provided by astralfoundry B.V. ("we", "our", or "us"), including our website, fitness facilities, and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

astralfoundry B.V. is a company registered in the Netherlands under company number NL31837296, with our registered office at Lindelaan 199, 4875 FI Breda, North Brabant, Netherlands.

These Terms constitute a legally binding agreement between you and astralfoundry regarding your use of our services.

Description of Services

astralfoundry provides fitness and wellness services including but not limited to:

• Access to fitness facilities and equipment

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to our members.

Membership and Registration

To access our services, you must:

• Be at least 16 years of age (parental consent required for minors)
• Provide accurate and complete registration information
• Maintain and update your account information
• Complete any required health and fitness assessments

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

We reserve the right to refuse service or terminate memberships at our discretion, particularly in cases of misconduct or violation of these Terms.

User Responsibilities and Conduct

As a user of astralfoundry services, you agree to:

Health and Safety

• Use equipment properly and responsibly
• Inform trainers of any discomfort or concerns during sessions
• Obtain medical clearance if recommended

Facility Use

• Respect other members and staff
• Maintain cleanliness and hygiene standards
• Follow facility rules and posted guidelines
• Report any equipment issues or safety concerns
• Wear appropriate workout attire and footwear

Prohibited Conduct

• Harassment, discrimination, or inappropriate behaviour
• Use of illegal substances or alcohol on premises
• Damage to property or equipment
• Unauthorised recording or photography
• Commercial activities without permission
• Sharing account access with non-members

Payment Terms and Cancellation

Payment for services is due according to your selected membership plan or service agreement. We accept various payment methods as indicated during registration.

Payment Obligations

• Payments are due in advance according to your billing cycle
• Late payments may result in service suspension
• You are responsible for keeping payment information current
• Price changes will be communicated with 30 days' notice

Cancellation Policy

• 30 days' written notice required for membership cancellation
• Individual session cancellations require 24 hours' notice
• Refunds are subject to our refund policy terms
• Unused sessions may be transferable under certain conditions

Health and Medical Considerations

Participation in fitness activities involves inherent risks. Before beginning any exercise programme with astralfoundry, you should:

• Take responsibility for your own health and safety
• Stop exercising and seek medical attention if you experience adverse symptoms

Intellectual Property

All content and materials provided by astralfoundry, including but not limited to workout plans, educational materials, training methods, logos, and website content, are protected by intellectual property laws and remain the exclusive property of astralfoundry B.V.

Your Rights

• Personal use of provided materials during your membership
• Access to educational resources as part of your service package
• Use of our facilities and equipment during operating hours

Restrictions

• No reproduction, distribution, or commercial use of our materials
• No reverse engineering of our training programmes
• No unauthorised sharing of proprietary content
• No use of our trademarks or branding without permission

Any feedback, suggestions, or ideas you provide to astralfoundry may be used by us without compensation or attribution.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

By using our services, you consent to the collection and use of your personal data as described in our Privacy Policy, including:

Limitation of Liability

To the maximum extent permitted by law, astralfoundry B.V., its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

• Your use of our services or facilities
• Any injury, illness, or adverse health effects
• Equipment malfunction or facility issues
• Loss of data or interruption of services
• Actions of other members or third parties
• Failure to achieve desired fitness results

Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you have paid to astralfoundry in the 12 months preceding the claim.

This limitation of liability applies regardless of the legal theory on which the claim is based, including contract, tort, negligence, or strict liability.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability shall be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless astralfoundry B.V., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

• Your use of our services or violation of these Terms
• Your negligent or wrongful conduct
• Any false or misleading information you provide
• Your violation of any third-party rights
• Any damage to our property or equipment caused by you

This indemnification obligation shall survive the termination of these Terms and your membership.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the competent courts in Breda, Netherlands.

Before initiating any legal proceedings, we encourage you to contact us directly to resolve any disputes amicably. We are committed to working with our members to address concerns in good faith.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights under applicable consumer protection laws.

Termination

Either party may terminate the service relationship in accordance with the following provisions:

Termination by You

• You may cancel your membership with 30 days' written notice
• Cancellation must be submitted according to our prescribed process
• You remain responsible for charges incurred up to the effective termination date
• Certain membership types may have specific termination conditions

Termination by astralfoundry

We may terminate your membership immediately if you:

• Violate these Terms or our facility policies
• Engage in dangerous, disruptive, or inappropriate behaviour
• Fail to pay required fees after reasonable notice
• Provide false information or misrepresent your identity
• Use our services in ways that could harm other members or our business

Effects of Termination

• Your access to our facilities and services will cease
• Outstanding payment obligations remain in effect
• Certain provisions of these Terms survive termination
• We may retain your data as described in our Privacy Policy

Force Majeure

astralfoundry shall not be liable for any failure to perform its obligations under these Terms if such failure is due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, floods, earthquakes, or severe weather
• Government regulations, orders, or restrictions
• Public health emergencies or pandemics
• Labour strikes or disputes
• Equipment failures or technical issues beyond our control
• Acts of terrorism, war, or civil unrest

During force majeure events, we will make reasonable efforts to minimise disruption and provide alternative services where possible.

Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

These Terms, together with our Privacy Policy and any specific membership agreement you sign, constitute the entire agreement between you and astralfoundry regarding your use of our services.

No waiver of any provision of these Terms shall be deemed a continuing waiver, and any waiver must be in writing and signed by an authorised representative of astralfoundry.

Changes to Terms

We reserve the right to modify these Terms at any time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes by:

• Sending email notifications to registered members
• Displaying notices at our facility
• Providing notice through our member portal or app

Your continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms.
